Nevertheless, use of the web site is conditioned on the User’s acceptance of all of the terms and conditions contained in or on the site. Use of the site constitutes the user’s agreement to abide by the aforementioned terms and conditions.
SMA Consulting does not warrant the accuracy, or completeness of the information, text, graphics, links and other items contained in this site or any other site.
Except as expressly provided above, nothing contained herein shall be construed as conferring by implication, estoppel or otherwise any license or right under any patent, copyright, trademark or other intellectual property right of SMA Consulting or any third party.
The material included in this web site has been compiled from a variety of sources, and is subject to change without notice from SMA Consulting. Digital Products Policy
Digital products are defined as electronic files, web pages, directories, and/or web site content subscriptions that are offered for sale and fulfilled on the www.smaconsulting web site.
All digital products become immediately available upon credit card confirmation. There are no shipping and handling charges for digital products. Sales tax only applies to customer’s whose credit card billing address is in Florida. Online content items are files or web pages available for sale on www.smaconsulting.net.
Content subscriptions purchased on www.smaconsulting.net are valid for one year from the date of purchase, unless otherwise specifically noted. At the end of one year, access to the content subscription will be revoked and the product must be purchased again to continue access for another year. Note that content found within a content subscription is subject to change on a daily basis. SMA Consulting recommends that any pages of interest found within the content subscription be downloaded and/or printed for future reference. SMA Consulting cannot provide customers with expired content once it has been removed from the content subscription.
Magazine Subscription Policy
Magazine subscriptions purchased 15 days prior to a magazine release will ship with the next release. Magazine subscriptions purchased within 15 days of a release will ship with the following release.
Membership Policy
A membership is defined strictly as a paid SMA Inner Circle Member, SMA CFO Client, or SMA Operational Client. SMA Consulting guarantees that all memberships are valid for one year from the purchasing date, unless specifically noted on a signed physical contract. At the end of one year, access to any exclusive membership materials, downloads, and content will be revoked and the membership must be purchased again.
All memberships are valid immediately upon credit card verification. Confirmation will be sent via email within 2 business days and follow-up collateral may arrive within 30 days via mail.
Registration Obligations
In consideration of customer’s use of SMA Consulting services, customer represents that he/she is of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States. Customer also agrees to: (a) provide true, accurate, current and complete information as prompted by any of the various SMA Consulting registration forms and (b) maintain and promptly update registration data to keep it true, accurate, current and complete. Failure to update contact information can result in undeliverable services. SMA Consulting is not responsible for lost materials due to not updating contact information.
Subscription Ownership and Modification Policy
Items purchased on or through this web site, such as digital products, print magazines and at-large memberships, are subscription-based items. For purposes of SMA Consulting’s content subscription records, the “Subscriber” is the person whose name is provided under:
“Shipping Information” during the checkout process if the purchase is a magazine or at large membership (even if the name of another individual or entity is provided under “Billing Information” or as “Main Contact”).
“Main Contact” or the “Contact Person” during the checkout process if the purchase is a digital product, such as online content subscription or PDF download (even if the name of another individual or entity is provided under “Billing Information”).
The Subscriber, as the person who has purchased either online access to view the content or the content itself, is deemed to be the sole owner of the content subscription, though materials purchased may be shared amongst employees within same company. Materials may not be duplicated, emailed, or generally shared with individuals not employed by same company as Subscriber.
Content subscriptions are non-transferable. Furthermore, only the Subscriber may modify the information in SMA Consulting’s content subscription records. Requests for modification must be received in writing, signed and dated by the Subscriber, and faxed to SMA Consulting at 407-386-7212, Attention: SMA Consulting Director of Marketing. An email from Subscriber to info@smaops.com is deemed acceptable as well.

No Resale of SMA Consulting Services or Products
Customers agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of any SMA Consulting service or product.
Cancellation Policy
Customers can cancel orders for memberships or magazine subscriptions within 30 days of purchase. Digital products cannot be canceled. If a customer cancels an order for a magazine or membership before it has been processed, the order will be canceled and no funds will be debited. If the order has been processed, a refund will be credited to the charge card used to make the purchase.

SMA Consulting may provide links to other World Wide Web site or resources. Because SMA Consulting has no control over such sites and resources, customer acknowledges and agrees that SMA Consulting is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. Customer further acknowledges and agrees that SMA Consulting shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
